Terms and Conditions

1. Parties, purpose and acceptance

This agreement is entered into between LocalTorneo (hereinafter, “LocalTorneo”, “we” or “the Platform”) and every person who accesses or uses the Platform (hereinafter, “the User”).

Its purpose is to regulate the use of the technology service of LocalTorneo to organize, manage, publicize and follow sports and recreational tournaments and competitions.

The User accepts this agreement electronically by ticking the acceptance box, by pressing the registration or sign-up button, or by continuing to use the Platform after an update. Such acceptance has the same validity and evidentiary value as a handwritten signature under the applicable legislation on data messages and electronic signatures. LocalTorneo keeps a tamper-proof record of each acceptance (version, date, time, IP address and browser), which the User acknowledges as valid evidence.

This agreement incorporates by reference the Privacy Policy, which forms an integral part of it.

2. Definitions

• Organizer: the person who creates and manages a tournament or an organization page.
• Club or team: a permanent team with its own page, managed by its person in charge (manager).
• Captain or delegate: the person who registers a team in a tournament or shares its roster link.
• Player: a person registered on a roster, by themselves or by a third party.
• Referee and scorer: those who record results, events and match sheets.
• User Content: texts, photos, logos, videos, links, comments, reviews and any data that the User uploads.
• Sports record: results, scores, statistics, sports sanctions, standings, rankings, awards and participation in competitions.

3. Capacity, age and minors

To create an account (organizer, club or team, referee) the User declares to be over 18 years of age and to have the legal capacity to enter into contracts.

Minors may appear only as players, and always with the prior authorization of their mother, father or legal representative, in accordance with the applicable legislation on the protection of children and adolescents. Whoever registers a minor (the minor with their representative, the captain, the club or the organizer) declares, under their sole responsibility, that they hold such authorization, including the authorization to publish the minor’s name, photo and sports statistics, and is liable to LocalTorneo and to third parties if they do not.

When the date of birth indicates that the player is a minor, the Platform requires the name of the authorizing representative and records it. LocalTorneo may remove a minor’s photo or data at any time at the request of their representative.

4. Nature of the service: LocalTorneo is only a tool

LocalTorneo is a technology service provider acting as an intermediary. LocalTorneo does NOT organize, sponsor, referee, endorse or supervise the tournaments, matches, events or activities published on the Platform, and is not a party to the agreements between organizers, clubs, teams, players, referees, sponsors or spectators.

Each organizer is solely responsible for their tournament: permits, rules, facilities, safety, insurance, medical assistance, prizes, charges, taxes and compliance with the law of the place where it is played. The publication of a tournament on the Platform does not imply any recommendation or guarantee by LocalTorneo.

5. Account, truthfulness and security

The User undertakes to provide true, accurate and up-to-date information, not to impersonate another person or a brand, and to use only one account per person.

The password and access are personal and non-transferable. The User is responsible for everything done from their account and must immediately notify [email protected] if they suspect unauthorized use.

If the User signs in with an external provider (for example Google), they also accept that provider’s conditions; LocalTorneo only receives their name, email and profile photo.

6. Which data is public and authorization to publish

The Platform exists to promote sport. Therefore the User understands and EXPRESSLY AUTHORIZES the following to be public, visible to anyone on the internet and on the results portals of LocalTorneo:

• First and last name, nickname, profile or roster photo, shirt number, position, category, team or club.
• Sports record: results, goals, points, assists, cards and sports sanctions, minutes or matches played, awards, standings and rankings.
• For organizers, clubs and referees: public name, city, biography, social networks, public contact details that they themselves write, reputation and reviews.

The following are NEVER published: identity document number, phone number, exact date of birth, email address, identity verification photos (selfies) and payment receipts. That data is seen, strictly as necessary, only by the tournament organizer and the authorized staff of LocalTorneo (see the Privacy Policy).

The authorization to use the name, image and sports record is free of charge, worldwide, non-exclusive and for the entire lifetime of the Platform, and includes their dissemination on the Platform, on its live portals and on its social networks for informational purposes and to promote sport. The User shall have no right to any compensation for such use.

7. License over the sports record and historical preservation

The results and statistics of a competition are facts of sporting interest and form part of a collective historical record: they belong to the tournament and to all of its participants, not just to one person.

Therefore the User grants LocalTorneo a free, worldwide, perpetual and IRREVOCABLE license to keep, display and disseminate the sports record in which they took part, associated with their name, even after deleting their account or ceasing to use the Platform.

Deleting the account erases the access and contact data (email, password, alias, phone) but does NOT erase results, match sheets, statistics or standings already generated. Only in justified cases (for example, the safety of a person or the protection of a minor) may LocalTorneo, at its sole discretion, anonymize the name in the sports record.

8. Obligations of the organizer

The organizer declares and warrants that:

• They hold the authorization of each player (and of their representative if a minor) to register their data on the Platform and to publish their name, photo and statistics, and will keep it in order to show it if requested.
• They comply with the laws of the place of the event: permits, use of venues, safety, insurance, medical care, image rights, data protection and taxes.
• Prizes, trophies, incentives and any other offers are their SOLE responsibility; LocalTorneo does not guarantee them or answer for their delivery.
• Charges for registration, refereeing, fines or any other item are agreements between the organizer and the teams. LocalTorneo does not process payments, does not receive or hold money, does not issue invoices for those items and is not liable for debts, refunds or fraud between users. The finance feature is only a supporting record.
• They will use the players’ personal data only for the tournament and never for other purposes.

9. Obligations of clubs, captains and players, and sports risk

Whoever registers a team or a player warrants that the data is true and that they hold the authorization of the persons registered.

Sport involves physical risks. Each player takes part of their own free will and at their own risk, declares to be in suitable physical condition and health, and assumes the risks inherent in the activity. LocalTorneo is not the organizer of the events and is not liable for injuries, accidents, illnesses, deaths, property damage, thefts or acts of violence occurring before, during or after a match or event.

10. Results, referees and scorers

Results, events, match sheets, sanctions and statistics are loaded by organizers, referees and scorers. LocalTorneo does not verify their accuracy and is not liable for errors, omissions, delays or for sporting or disciplinary decisions. Complaints about a result must be addressed to the tournament organizer. Any forecasts, probabilities or indicators shown by the Platform are informational estimates without any guarantee.

11. Identity validation and data pre-filling

To speed up registration and prevent impersonation, the Platform may consult third-party validation services (for example, for Venezuelan ID cards (cédulas)) that return identity data (name, date of birth, sex and phone number) to pre-fill the form. Pre-filled data is editable and only what the User confirms is saved.

The User declares that they will only look up their own document or that of a person who has authorized them to register them. It is PROHIBITED to use this feature to find out data about third parties. Without signing in, each device may look up at most two (2) different documents every thirty (30) days; only organizers and clubs signed in may look up more, because they build rosters. Each query is recorded (who, when, from which connection and an encrypted fingerprint of the document queried). Misuse may constitute a criminal offense under criminal legislation on computer crimes and violation of data privacy, and LocalTorneo will hand over those records to the competent authorities that request them. The User who misuses it is personally and exclusively liable.

12. Account deletion

The User may delete their account at any time from their dashboard. Deletion is final: their email, password, alias and contact data are anonymized, their sessions are closed and they will not be able to sign in again with that account.

In accordance with clause 7, the following are retained: the sports record, the tournaments and matches already played (including those organized or refereed by the User, with their name as it appeared), and the acceptance and audit records that the law or the defense of rights requires. A player’s identity data (document, phone number, date of birth, verification photo) may be deleted upon their written request to [email protected], unless it must be kept due to a legal obligation.

13. User Content

The User is solely responsible for the content they upload (texts, news, photos, logos, crests, videos, streaming links, sponsors, comments and reviews) and warrants that they hold all necessary rights: copyright, trademark, image rights of the people who appear, and any others.

The User grants LocalTorneo a free, worldwide, non-exclusive license to host, reproduce, adapt (for example, compress or crop) and display that content on the Platform and in its promotion while it remains published.

Unlawful, defamatory, insulting, discriminatory, violent or sexual content, content affecting minors, content infringing third-party rights, content promoting illegal gambling, or content containing third-party personal data without their consent is prohibited.

LocalTorneo does not review content before it is published, but may remove it, without notice or liability, when it considers it contrary to this agreement or to the law. Anyone who believes that content infringes their rights may request its removal at [email protected], indicating the link, the reason and their contact details; LocalTorneo will review it and, if appropriate, remove it.

14. Reviews, reputation, points and benefits

Reviews, ratings, prize confirmations and comments are the opinions of the users who write them and not of LocalTorneo, which neither shares nor guarantees them. LocalTorneo may moderate or hide them.

Reputation, levels and LocalTorneo Points are an internal incentive system with no monetary value: they are not money, they are not the User’s property, they cannot be sold, transferred or exchanged for money, and LocalTorneo may change their rules, adjust them or cancel them (for example, in case of abuse or error) at any time. Redeemable benefits depend on availability and on the approval of LocalTorneo.

15. This is not a betting platform

LocalTorneo does not offer, organize or promote games of chance or betting. It is prohibited to use the Platform, its results or its data to operate illegal betting. Statistics and forecasts are for informational and entertainment purposes only.

16. Prohibited conduct

The User undertakes not to:

• Extract data in bulk or in an automated way (scraping, bots) without written authorization.
• Attempt to access other people’s accounts, data or systems, test vulnerabilities without permission, interrupt the service or overload it.
• Copy, decompile or reverse engineer the software.
• Impersonate people, teams, organizations or brands.
• Register people without their authorization or with false data.
• Send unsolicited advertising or use other users’ data for purposes other than the tournament.
• Use the Platform for any unlawful purpose.

17. Intellectual property of LocalTorneo

The LocalTorneo trademark, its logo, its slogan, the design, the software, the databases as a whole and the texts of the Platform are the property of their owner or its licensors and are protected by intellectual property laws. This agreement grants the User no rights over them, except for the personal use of the Platform in accordance with these conditions.

18. Free of charge, changes and availability of the service

Today the service is free of charge. LocalTorneo may offer paid features in the future, giving advance notice; nothing will be charged without the User’s express acceptance.

The Platform is provided “as is” and “as available”. LocalTorneo may modify, suspend or discontinue features, modules or the entire service, and does not guarantee that it will work without interruption or errors or that data will be kept without loss. The User is responsible for keeping a copy of any information that matters to them.

19. Limitation of liability

To the maximum extent permitted by applicable law, LocalTorneo, its owner, partners, employees and suppliers are not liable for indirect, incidental, special or punitive damages or loss of profits, nor for loss of data, opportunities or reputation, arising from the use of or inability to use the Platform, from the content or conduct of other users, from sporting events, from prizes or payments between users, or from linked or integrated third-party services.

In any case, the total liability of LocalTorneo to a User for any cause is limited to the amount that such User has paid to LocalTorneo in the twelve (12) months preceding the event, or fifty United States dollars (USD 50) if the service was free of charge, whichever is less.

Nothing in the foregoing excludes liability that cannot be excluded by law, such as that arising from willful misconduct.

20. Indemnity

The User undertakes to indemnify and hold harmless and to defend LocalTorneo, its owner, partners and employees against any claim, lawsuit, penalty, damage or expense (including attorneys’ fees) arising from: their breach of this agreement or of the law, the content they uploaded, third-party data they registered without authorization, the tournaments or events they organized or took part in, and prizes, charges or agreements with other users.

21. Suspension and termination

LocalTorneo may suspend or cancel, in whole or in part, an account, a tournament, a page or a piece of content, without prior notice and without liability, when there are indications of a breach of this agreement or of the law, of fraud, of impersonation, of risk to other users, or by order of an authority. Clauses 6, 7, 13, 14, 19, 20, 24 and 25 remain in force after the agreement has ended.

22. Force majeure

LocalTorneo is not liable for failures or delays caused by events beyond its reasonable control, such as power or internet outages, cyberattacks, supplier failures, natural disasters, conflicts, epidemics or acts of authority.

23. Changes to this agreement

LocalTorneo may update this agreement and the Privacy Policy. The current version will always be published with its date. If the change is significant, the Platform will ask the User to accept it again before continuing to use it; if they do not accept it, they may delete their account. Prior registrations and records are governed by the version accepted at the time, except where the new version is more favorable to the User.

24. Electronic communications and messages

The User agrees that communications from LocalTorneo may be made by electronic means (the Platform itself, email or notifications) and that they have full validity.

By registering a phone number, the User (or the person who registers them with their authorization) agrees to receive on that number messages related to their activity on the Platform (for example: registrations, schedules, results, match changes, pending payments) via WhatsApp, Telegram, SMS or other messaging services, sent by LocalTorneo or by the tournament organizer. Promotional messages will only be sent with their consent and they may ask to stop receiving them at any time.

25. Governing law, amicable resolution and arbitration

This agreement is governed by the laws of the Bolivarian Republic of Venezuela.

Before initiating any action, the parties undertake to try in good faith to resolve any dispute by means of a written claim sent to [email protected], with a minimum period of thirty (30) consecutive days of direct negotiation. No action may be initiated without having exhausted this stage.

If no agreement is reached, any dispute arising out of or relating to this agreement shall be finally resolved by arbitration under law, in accordance with the Commercial Arbitration Law and the rules of an arbitration center seated in Caracas, by one (1) arbitrator, in the Spanish language. The award shall be final and binding. The parties waive recourse to the ordinary courts, except for enforcement of the award or for interim measures.

To the extent permitted by law, each claim shall be handled individually and not as a class or representative action, and must be filed within one (1) year after the event giving rise to it.

If the User is a consumer and the law of their country mandatorily grants them the right to claim before their own courts or consumer protection bodies, that law shall apply to the extent it cannot be waived.

26. General provisions

• Severability: if a clause is found to be null or unenforceable, it shall be adjusted to the minimum extent necessary and the rest shall remain in force.
• No waiver: the fact that LocalTorneo does not enforce a right at a given time does not mean that it waives it.
• Assignment: the User may not assign this agreement; LocalTorneo may assign it to a successor or purchaser of the service.
• Entire agreement: this agreement and the Privacy Policy are the entire agreement between the parties on its subject matter.
• Language: it is published in several languages; in case of any discrepancy, the Spanish version prevails.
